Olmsted County Smoke-free Ordinance & Minnesota Freedom to Breath Act

Olmsted Ordinance became effective on June 1, 2007. The Minnesota Freedom to Breath Act took effect on October 1, 2007.

Smoking is prohibited in virtually all public places and indoor places of employment with more than one employee. This includes bars, restaurants, offices, retail stores, common areas in apartments & hotels, public transportation, work vehicles with more than one present and day care premises. Some exceptions include private residences and automobiles, tobacco shops where products are sampled, farm trucks and family farm buildings, and as a part of a theatrical performance.

In Olmsted County: Smoking is prohibited in the vicinity of youth at all parks and recreational areas. Rochester City Park Board prohibits smoking on park property.
